GateLog SA Terms of Service

Terms, disclaimers and usage conditions for the GateLog SA application.

These Terms of Service apply to the use of the GateLog SA application, related Google Drive/Google Sheets databases, setup services, support services, trial databases, client-owned databases and any related functions made available by GateLog SA.

By installing, accessing or using GateLog SA, the client and user accept these terms. If the client or user does not agree with these terms, the app should not be used.

1. Nature of the service

GateLog SA is a data-capture and visitor logging tool. It assists with recording gate access activity such as vehicle entries, vehicle exits, pedestrian entries, pedestrian exits, visit reasons, deliveries, collections, licence warnings, device information and related administrative records.

GateLog SA is not a complete security system, emergency response system, legal compliance system, identity verification authority, access-control guarantee, insurance product or substitute for trained personnel and proper site procedures.

2. Own-risk use

The app is used at the client’s and user’s own risk. The client remains responsible for deciding whether the app is suitable for its site, procedures, legal obligations, access-control policies, device environment and staff capability.

GateLog SA, its developers, owners, suppliers, support personnel and service providers are not responsible for any loss, damage, claim, incorrect entry, missed entry, missed exit, failed scan, failed upload, network failure, device failure, Google account problem, Google Drive problem, Google Sheets problem, incorrect setup, user error, unauthorised access, or any direct or indirect consequence arising from the use or inability to use the app, except where liability cannot legally be excluded.

4. No guarantee of security or accuracy

GateLog SA does not guarantee that a person, vehicle, licence disc, driver licence, ID document or visitor detail is genuine, valid, lawful or safe. The app may extract and save information, but it does not replace human verification or site rules.

The app does not guarantee that entries and exits match, that a person is still on site, that a vehicle has left, or that all data is complete. Entry and exit records are data-capture records and should be reviewed by authorised personnel where important decisions depend on them.

5. Google services and third-party dependency

GateLog SA may depend on Google sign-in, Google Drive, Google Sheets, internet connectivity, mobile devices, operating-system permissions and third-party packages or services. GateLog SA is not responsible for outages, policy changes, access restrictions, quota limits, account suspensions, permission changes or other third-party service issues.

Where the app creates or uses a Google Drive database, the client must ensure the Google account remains active and accessible.

6. Trial and client-owned databases

During a trial, data may be stored in a GateLog SA trial database or trial cloud structure. After payment or activation, data may be moved or linked to a client-owned Google Drive database. Migration, changeover and deletion of old trial data must be verified carefully.

Old trial databases should only be deleted after the client-owned database is created, archive data is copied, totals are checked and the changeover is marked as verified. GateLog SA may keep a short manual safety period before deleting old trial records.

7. POPIA and personal information

The client is normally the responsible party for personal information captured at its site. The client must ensure that the collection, use, retention, access and deletion of personal information complies with POPIA and any other applicable requirements.

GateLog SA may process information as a software/service provider and may assist with setup, migration, support and troubleshooting. GateLog SA does not determine the client’s access-control purpose, visitor policies or legal basis for capturing personal information unless expressly agreed in writing.

8. Support limitations

Support may be provided for reasonable setup, app and database issues. Support does not include legal advice, security consulting, forensic investigation, guaranteed data recovery, Google account recovery or responsibility for client hardware unless separately agreed.

9. Limitation of liability

To the maximum extent permitted by law, GateLog SA and its related persons are not liable for indirect, special, incidental, punitive or consequential loss, loss of profits, loss of business, loss of data, interruption, reputational damage, security incidents, unauthorised access, or claims arising from client procedure failures, staff conduct, device misuse or third-party service failure.

Where liability cannot legally be excluded, it is limited as far as the law allows.

10. Changes

GateLog SA may update these terms from time to time. Continued use of the app after updates means the client and user accept the updated terms.
